Terms & Conditions

Please read the following terms carefully. By engaging our services, you agree to these conditions.

These Terms & Conditions apply to all quotations, agreements, and works carried out by RQ Trading Pty Ltd, trading as Rainbow Quartz (“we”, “us”, “our”).

1. Quote Validity

Any quotations provided are valid for 14 days from the date issued unless otherwise stated in writing. Pricing is subject to change after this period.

2. Acceptance of Quote

Acceptance of a quotation, whether in writing or by authorising work to commence, constitutes full acceptance of these Terms & Conditions.

3. Payment Terms

A deposit of up to 6.5% of the quoted price may be required prior to commencement of work, in accordance with the Home Building Contracts Act 1991 (WA). Progress payments may be required throughout the course of the work and will be outlined on your quotation. Progress payments are only invoiced for work already completed or materials already supplied to site.

The final balance is payable upon completion of works unless otherwise agreed in writing. Late payments may incur additional fees. We reserve the right to suspend or cease work until outstanding payments are received.

4. Variations

Any variations, additions, or extra work not included in the original quotation will be charged separately. Where possible, all variations will be discussed and agreed upon with the client prior to the work being carried out.

5. Site Access

The client must provide safe, clear, and reasonable access to the work area during normal working hours. Any delays or additional costs resulting from restricted, unsafe, or inadequate access may be charged to the client.

6. Unforeseen Conditions

If unforeseen site conditions arise that could not reasonably have been identified at the time of quoting, additional costs may apply. These will be discussed with the client before proceeding where possible.

7. Materials & Delays

While every effort will be made to complete work within the estimated timeframe, we cannot be held liable for delays caused by inclement weather, material shortages, supplier delays, or other factors beyond our reasonable control.

8. Rainbow Quartz & Application

Rainbow Quartz is applied by hand. Due to the nature of hand-applied finishes, no two pools will look exactly the same. Variations in colour, texture, and aggregate distribution are inherent to the process and should be expected. Minor inconsistencies in application are a normal characteristic of hand-applied pool plaster and are not considered defects.

9. Pool Filling

Following the application of plaster, the pool must be filled with water immediately and continuously without interruption. The client is responsible for ensuring an adequate and uninterrupted water supply is available on the scheduled fill date. Any damage, discolouration, cracking, or defects resulting from delayed, interrupted, or incomplete filling of the pool are not covered under warranty and are the responsibility of the client.

10. Chemical Treatment & Startup

Proper chemical treatment and water balancing during the initial startup period is critical to the longevity of the plaster finish. Unless startup services have been included in the quotation, the client is responsible for ensuring correct water chemistry is established and maintained from the time the pool is filled. Damage to the plaster surface caused by improper chemical treatment, including but not limited to incorrect pH levels, calcium hardness, or alkalinity, is not covered under warranty.

11. Damage & Pre-Existing Conditions

We are not responsible for damage resulting from pre-existing structural issues, hidden defects, or conditions not visible or reasonably identifiable at the time of quoting. Any such conditions discovered during the course of work will be reported to the client.

12. Cancellation

If work is cancelled by the client after acceptance of a quote, the client may be liable for all costs incurred up to the date of cancellation, including but not limited to materials purchased, labour completed, and any restocking or return fees.

13. Warranty

Rainbow Quartz carries a 7-year product warranty. Evidence of regular and appropriate pool maintenance will be required to support any product warranty claim, including but not limited to maintaining correct water chemistry, regular servicing, and care in accordance with manufacturer guidelines.

Workmanship is warranted for a period of 12 months from the date of completion. Warranty does not cover normal wear and tear, misuse, neglect, improper chemical treatment, damage caused by external factors, failure to follow pool filling or startup procedures, or failure to maintain the pool in accordance with industry standards.

14. Ownership of Materials

All materials supplied by us remain our property until full payment has been received. Title passes to the client only upon receipt of all monies owed.

15. Limitation of Liability

To the maximum extent permitted by law, our total liability in connection with the works shall not exceed the total contract price. We shall not be liable for any indirect, consequential, or incidental loss or damage.

16. Disputes

In the event of a dispute, both parties agree to attempt to resolve the matter through good faith negotiation before pursuing any formal legal proceedings.

17. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of Western Australia. Both parties submit to the exclusive jurisdiction of the courts of Western Australia.
